An appeal was entered today in the case of who is in charge of 770 – Lubavitch World Headquarters in Crown Heights, Brooklyn.
Representatives of both sides were on hand in court Tuesday, each presenting their case to a panel of four judges, Justices Edward D. Carni, Howard Miller, David S. Ritter and Robert A. Spolzino.
Agudas Chassidie Chabad Chairman Rabbi Avrohom Shemtov, Connecticut Rabbi Yisrael Deren, Merkaz L’Inyonei Chinuch employee Mendy Scharfstien and JEM director Elkana Shmotkin were in attendance, as well as 30 people with the messianic side of the defense, including Rabbi Kuti Rapp, Rabbi Yitzchak Springer, Rabbi R. Blau, and Rabbi Lipsker.
The judge heard both sides’ lawyers, and asked many detailed questions of each, while trying to understand the Rebbe’s view on the Gabboim and their role in 770.
The Judge on the original case, Judge Ira Harkavy, was in the audience, apparently interested in seeing what the final outcome would be. This was only possible because he is currently retired as a judge.
The verdict on whether the case will continue is expected to take at least six weeks, and up to one year.
But this is a public occurrence…

Having started out as big yechinik I must say that the situation is so out of control it has completely turned me off.
Humiliating the community Rabbonim – was the last straw for me.
For people who believe that the Rebbe is here they sure dont behave like it. enough is enough. Wearing a yechi pin or waving a flag or saying yechi a hundred times doesn’t prove a persons connection to the Rebbe. How about behaving as if they were really standing in front of the Rebbe.
